Regional Center Update: ARCFE Reports I-485 and I-829 Approvals for Groups 7 and 8; Group 22 Skyline2 Breaks Ground in Long Island City

New York regional center ARCFE published four approval notices for its Group 7 and Group 8 projects, spanning the I-485 adjustment and I-829 removal-of-conditions stages, and held a groundbreaking ceremony on June 12 for Group 22 (Skyline2, to be branded Vera).

This column collects project progress and adjudication results that regional centers publish, so investors can follow industry activity. The items below come from public posts by New York regional center ARCFE and have not been independently verified by this site.

Groups 7 and 8: I-485 and I-829 approvals

On October 10, ARCFE announced four approval notices across its Group 7 and Group 8 projects, at two key stages:

  • I-485 approvals: the applicant moves from a lawful nonimmigrant status to conditional permanent residence with a two-year green card. The investment must still be sustained and jobs created, and an I-829 must later be approved.
  • I-829 approvals: USCIS confirms that the investment was sustained and the jobs were created; the investor’s conditions are removed and unconditional permanent residence is granted — the final step of the EB-5 process and the ultimate test of a project’s immigration outcome.

The same post mentions an installment-payment arrangement available on certain ARCFE projects (a first installment of $200,000), noting that terms are governed by the offering documents, that installments do not change the statutory minimum, and that whether the arrangement satisfies I-526E requirements and establishes a priority date must be reviewed by counsel in light of actual contributions and source of funds.

Editorial note: installment structures are not unusual in the industry, but investors should be aware that USCIS adjudicates the I-526E on the basis that the full statutory amount has been invested or is actively in the process of being invested. The legal effect of any installment plan must be assessed case by case by counsel.

Group 22: Skyline2 breaks ground

On the morning of June 12, ARCFE’s Group 22 project — the Skyline2 boutique residential development in Long Island City — held its groundbreaking ceremony in New York, attended by the development team, partner representatives, and a representative of the city planning department. iCross × ARCFE founder Lily Guo and United Construction & Development Group CEO Chris Xu spoke. On completion the building will be branded Vera.

A groundbreaking marks mobilization of equipment and crews on site. For investors following the project it is a substantive milestone; the next ones to watch are foundation completion, topping out, the Temporary Certificate of Occupancy, and lease-up or sales progress.
